Terms of Service

Acceptance and eligibility

By creating an account or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use Zapters. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf.

The service

Zapters is an AI creative studio: you write prompts and provide reference material, and AI models generate the images, video, music and voices you assemble into finished episodes. Content you create is private to you unless you choose to share it outside the Service.

AI outputs are machine-generated. They can be inaccurate, imperfect or unexpected, and may resemble other works. You are responsible for reviewing everything you create before you use or share it, and you must present AI-generated content honestly — never as authentic footage of real people or real events where that could mislead.

Zero-tolerance content policy

We have zero tolerance for objectionable content and abusive behavior. This policy applies to prompts, uploaded reference material and generated output alike, whether or not the content is ever shared. The following are strictly prohibited:

• Sexual or pornographic content of any kind.
• Any sexual content involving minors — real, fictional, animated or AI-generated. This is prohibited without exception and will be reported to the relevant authorities.
• Explicit nudity.
• Glorified graphic violence or gore.
• Sexualizing or impersonating real people without their consent.
• Harassment, bullying, threats or hateful conduct directed at any person or group.
• Content that promotes or facilitates serious illegal acts.

Voice and likeness consent

You may only upload or clone voices, faces or likenesses that are your own, or that you have documented consent to use from the person concerned. We may ask you to demonstrate that consent, and we remove content and terminate accounts that use another person’s voice or likeness without it.

Moderation and enforcement

We actively moderate the Service. Prompts, uploads and generated output are automatically filtered against this content policy, and flagged material is escalated to human review.

We may refuse to run a generation, remove content, and suspend or terminate the accounts of users who violate this policy — at any time and without notice. When a generation is blocked by moderation, the credits reserved for it are refunded.

Reporting content

Every generated item in the app carries a “Report content” action, and you can always reach us at support@zapters.app. We review reports and act on them within 24 hours — including removing the offending content and ejecting the user responsible where this policy has been violated.

Your content and license

You own the content you create with Zapters, to the fullest extent permitted by law. You are responsible for the material you upload and represent that you hold the rights needed to use it on the Service.

So that we can operate the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process and moderate your content — solely to provide, secure and improve the Service. This license ends when the content is deleted from the Service.

Credits and payments

Generations are paid for with credits. Credits are a virtual currency, not money: they have no cash value, cannot be exchanged for cash and are non-transferable. Plan credits reset at each monthly renewal; pack credits do not expire. Credits reserved for a generation that is blocked by moderation are refunded.

Purchases are made through the Apple App Store or Google Play and are managed by RevenueCat. The store’s own payment terms apply, and refunds for purchases are handled by the store.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that generated output will meet your expectations or be fit for any particular use.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total aggregate liability for claims relating to the Service is limited to the amounts you paid us in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.

Changes to these terms

We may update these Terms as the Service evolves. If a change is material we will give you reasonable notice — in the app or by email — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of Germany, excluding its conflict-of-law rules. If you are a consumer, the mandatory consumer-protection rules of the country you live in remain unaffected.
